A trial date has been set for the driver in a fatal two-car accident that killed an 8-year-old Warrenton boy.

Rodney Aaron Martin, 22, of 915 Fire Trail Road in Linden was indicted last week on a charge of aggravated involuntary manslaughter for the May 11 car accident.

His trial is scheduled to begin Dec. 8.

A grand jury indictment means that there is sufficient evidence for prosecutors to take a case to trial. It is not a finding of guilt or innocence.

Martin's 1998 Toyota Tacoma rear ended a 2004 Honda Odyssey stopped in the left turn lane at the intersection of Lee Highway and Somerset Crossing Drive in Gainesville about 6 a.m. on May 11, police said.

Joshua Adams, 8, was lying in the back seat of the Honda Odyssey when it was struck.

The boy, who was not wearing a seat belt, flew forward into the van's center console. He was flown to an area hospital where he later died.

His mother, a 52-year-old woman who was also a passenger in the van, was also flown to the hospital with serious injuries.

The boy's 20-year-old brother, who was driving the van, was treated at the scene for minor injuries.

Martin was taken to an area hospital and treated for injuries.

If convicted of aggravated involuntary manslaughter, Martin faces one to 20 years in prison.

Depending on the situation, I can understand the kid lying down on the backseat.. I do that quite often on long trips myself.. not anymore

i went to school with aaron and from what i hear from classmates, he was not “trashed” at the time of the accident and was sleeping at a friends house before driving home, which in my mind is the responsible thing to do. the minivan slammed on its brakes in front of him and he didn’t have time to stop.
i agree, the driver should be charged for not making sure the kid had his seatbelt on.

we are too quick to judge without knowing the whole story…my thoughts and prayers are with both families.

Why wasn’t Martin paying attention the vehichle stopped in front of him.  Seems to me regardless he is at fault. And I beleive from the first time this was published alcohol was involved.

I agree. I don’t know the whole story, but I have to wonder if the driver is really responsible for the boy’s death.

People - if you’re not going to wear your seatbelts, at least buckle up your kids!

So the guy hits the car in font of him yes he is responsible for the accident, but the boy did not have on his seat belt so why isn’t the driver being charged for not securing his passenger who probably would be alive if he had his seat belt on!
